The annual update of the CPI of lease contracts is limited to 2%
Last March 29, Royal Decree Law 6/2022 was published in the Spanish Official State Gazette (BOE following Spanish abreviation) and came into force on March 31. This legislation incorporates urgent measures within the "National Plan of response to the economic and social consequences of the war in Ukraine". The legislator places special emphasis on containing the impact of high inflation.
In this regard, the Article 46 establishes an extraordinary measure regarding the maximum increase of the Consumer Price Index (CPI) in those housing lease contracts the rent of which has to be updated during the period between April 1 and June 30, 2022 on a non-retroactive basis. This non-retroactivity implies that the updates practiced before April 1 are not affected.
The rule differentiates between large holders and other owners, but, for practical purposes, it affects everyone in the same way.
We would like to take this opportunity to comment that the Constitutional Court sentence banning certain articles of Law 11/2020 on rent containment has not yet been published and, therefore, has not yet entered into force. We will keep you informed
